The Arizona Registrar of Contractors advises homeowners to protect themselves by hiring only licensed contractors.

Licensed Contracting is the Law.

Licensed contractors offer many protections to the property owner. For example, licensed contractors must pass trade exams and demonstrate verifiable adequate experience to perform the construction authorized by their license and must pass a business exam.

Licensed contractors also must possess insurance and bonds that provide financial protection if an accident occurs on your property, or the work doesn’t comply with minimum construction standards.

Licensed, Bonded and Insured?

Just because the ad or the Contractor says they are, doesn’t mean it’s true!

If the Company is licensed, they are required to provide their Arizona Registrar of Contractors License number on all advertising, business cards, quotes, contracts, websites, etc. If they are not licensed they must state “Not a Licensed Contractor” and they are limited to projects that are less than $1,000 dollars under the “Handyman” exclusion. That is the law in Arizona.

Some Walk-In Tub Companies will tell you that their installers are a licensed contractor. The law says that the company that is selling you the tub cannot collect the money and pay a licensed contractor for the installation. In essence they are still illegally contracting to a sub contractor. The company that is selling you the tub including the installation must be a licensed contractor. That is the law in Arizona.

Contracting without a license is a crime and is subject to fines, penalties and even jail time.

Many complaints about unlicensed contractors are received where the home or business owner believed they had contracted with a Licensed, Bonded, and Insured contractor, but they had not. The ads that appear are not regulated by the publisher, and should be considered accurate only about the name of the company or individual and the phone number to call. The only sure way of knowing that your contractor is licensed is to check with the Registrar of Contractors to confirm it.

With the technology available today, the local phone number you think you are calling may be answered in some other state. This is especially true of websites. Such operations may not be licensed in Arizona, or even have a physical presence in our state. Ask them what their license number and business address is. Then verify. You might be paying thousands of dollars down on work that will never be performed or completed, or down the road if you need service they are not here. Why would a company not provide their business address and contractor’s license number on their website?

Sales Taxes

If the company that you are using for your home improvement project is a legitimate company and licensed by the Arizona Registrar of Contractors, they must also be licensed by the Arizona Department of Revenue to collect and pay taxes. This is called the TPT License, or Transactional Privilege Tax License or Sales Tax License. Almost everything that you buy is subject to this tax. Ask the company what their TPT License number is. If they don’t have a license they are not a legitimate business in Arizona. You can verify the license number at the Arizona Department of Revenue.

Some Walk-In Tub companies are claiming that there is no sales tax as the Walk-In Tub is considered a “medical device”. Not true. We have requested and received a determination from the Arizona Department of Revenue. We have written documentation that In Arizona the company that is selling and installing the Walk-In Tub must collect and pay sales taxes at the standard contracting rate, just like any other home improvement. When you pay Sales Taxes in Arizona you are supporting your local communities.

Homeowners and businesses can protect themselves by:

Consulting the Arizona Registrar of Contractors, or calling 1-877-692-0762 to ensure the contractor is licensed and in good standing.
Check with the Better Business Bureau or calling 1-877-291-6222 to check that the company is in good standing.
Asking for detailed written estimates from at least three contractors. Not a price on the back of a business card.
Requesting a list of references, and checking them before agreeing to hire anyone.
Making sure the scope of the project, the price, the time frame, the responsibility to obtain building permits, payment schedule and any other relevant terms are spelled out in a written agreement.
Avoiding contractors who require large upfront payments.
Never making a hurried decision. No reputable contractor will pressure you into a quick hiring decision. “The price is only good today”
While not required by statute, it is a good idea to make sure the contractor is insured and can provide proof of insurance. If the company doesn’t have the proper insurance it could leave you liable in case of an accident or mishap.
